1. General

1.1 These terms and conditions (the “Conditions”) govern participation in the Tatcha Pro Artist Programme (the “Programme”). By applying for or participating in the Programme, you confirm that you have read, understood, and agree to be bound by these Conditions.

1.2 These Conditions apply exclusively and take precedence over any other terms you may seek to impose or incorporate, or which may be implied by law, trade custom, practice, or course of dealing.

1.3 All purchases made under the Programme are also subject toTatcha’s Terms of Service, which are incorporated into these Conditions by reference and available at: https://www.tatcha.co.uk/pages/terms-of-sale

2. Definitions

In these Conditions:

“Company”, “we”, “us”, “our” means Tatcha (UK) Limited, registered in England and Wales under company number 09664383, with its registered office at Fifth Floor, Union House, 182-194 Union Street, London, SE1 0LH

“Artist”, “you”, “your” means the individual applying to participate in the Programme and purchasing products from the Company under these Conditions.

“Contract” means the legally binding agreement between the Company and the Artist for the sale and purchase of products and/or participation in the Programme, incorporating these Conditions and the Terms of Service.

3. Eligibility

3.1 The Programme is open only to individuals who are currently working as a professional Makeup Artist in the United Kingdom.

3.2 To apply, you must:

a) complete the Tatcha Pro Artist Programme Application Form (the ‘Application form’);

b) provide valid proof of current professional credentials and identification; and

c) renew your membership annually by providing updated documentation.

3.3 The Company reserves the right, at its sole discretion, to approve or reject any application and may request additional supporting documentation at any time.

3.4 Products purchased under the Programme are supplied strictly for your personal use only. You will benefit from a 30% discount on products, up to a maximum of six (6) products per calendar month. Any products purchased in excess of this limit will be charged at the normal recommended retail price (RRP). Products purchased may not be resold, transferred, or used for the provision of professional treatments or services.

3.5 Artists in the Programme are not entitled to join any other Tatcha subscription or rewards schemes and cannot use PayPal to pay for purchases made under the Programme.

4. Registration and Conclusion of the Contract

4.1 You may register on the Tatcha website by completing and submitting the Application Form. During registration, you will select a personal username and password. You must keep your password confidential and must not disclose it to any third party. 

4.2 The Application Form constitutes an offer from you to set up an account, which will enable you to purchase products (subject to the 30% discount and six-product monthly limit described in clause 3.4). The Application Form will be deemed accepted when we:
 (a) confirm that we have accepted it; and/or
 (b) email you a link to set up a password for your account, at which point the Contract will come into effect.

4.3 Registration alone does not create any obligation for You to purchase the products we offer. You may cancel your registration at any time by contacting the team at pro@tatcha.co.uk who will confirm the cancellation. If your personal details change, it is your responsibility to update them directly or notify us of the changes. By registering, you agree to the applicability of these Conditions for all future purchases made under your registered account.

4.4 Once registered, you will gain access to the ordering portal (Tatcha – MyAccount).

5. Ordering

Orders for products or services may be placed by You online through My Account at http://www.tatcha.co.uk.

6. Termination

6.1 Any misuse of the Programme, breach of these Conditions or the Terms of Sale, provision of false information, or attempt to circumvent the six-product monthly limit or pricing rules may result in immediate termination of your participation, without notice, and withdrawal of any associated benefits.

6.2 The Company reserves the right to amend, suspend, or withdraw the Programme at any time without liability, subject to honouring any confirmed orders already accepted prior to such change.

7. Amendments to Programme Terms

7.1 Tatcha reserves the right to amend or update these Programme Terms at any time without prior notice. Any such amendments shall take effect upon publication on Tatcha’s website.

7.2 It is your responsibility to review the Programme Terms regularly to remain informed of any updates.

8. Data Protection 

8.1 Tatcha processes personal data in accordance with applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

8.2 Personal and account data provided by You will be collected, stored, and processed by Tatcha for the purposes of administering the Programme, fulfilling orders, providing support services, and managing the customer relationship.

8.3 Your data will be handled in accordance with Tatcha’s Privacy Policy (https://www.tatcha.co.uk/policies/privacy-policy), which is available on its website and may be updated from time to time.

8.4 Tatcha may use such data to:

- Manage customer engagement and Programme participation;

- Monitor account activity and transaction history;

- Send service communications and marketing materials (where consent has been provided or a lawful basis applies); and

- Improve the delivery and effectiveness of its products and services.

8.5 Tatcha will implement appropriate technical and organisational measures to protect personal data against unauthorised or unlawful processing, accidental loss, destruction, or damage.

8.6 You have the right to access, rectify, or request deletion of your personal data, as well as the right to object to or restrict certain forms of processing. Requests may be submitted in accordance with the process outlined in Tatcha’s Privacy Policy (https://www.tatcha.co.uk/policies/privacy-policy).

9. Governing Law

These Conditions, together with the Terms of Service, and any Contract shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute arising out of or in connection with them.
